The following General Terms and Conditions (GTC) govern the legal relationship between the users of the "BenitaSana" platform and
Assistenz im Alltag AG Im Güggelchrüz 2 4104 Oberwil BL Switzerland
(hereinafter referred to as "BenitaSana" or "Platform Operator").
The BenitaSana platform is operated both as a mobile application (App) and as a web platform. These GTC apply to all uses of the platform, regardless of whether access is via a mobile app or a web browser.
BenitaSana operates a digital platform with a social purpose, aiming to facilitate access to suitable support and service offerings for people in need of assistance in daily life.
The platform serves as a neutral marketplace where supply and demand in the field of outpatient support are technically matched.
Through the platform, service providers, aid and social organizations, specialty retailers, therapeutic providers, Spitex, private helpers, and other providers can independently post their support offerings. The offered services may include household help, nursing and care services, transport and escort services, therapeutic services, assistive devices, medication management, and daily life assistance. At the same time, the platform is aimed primarily at seniors, people with disabilities, chronically ill individuals, as well as relatives and caregivers. They can use BenitaSana to create requests for needed services, compare providers, and book the suitable one.
BenitaSana provides the technical infrastructure that allows users to publish, find, and interact with offers. Any display, sorting, or presentation of offers is based solely on technical, usage-related, or system criteria and does not constitute content-based evaluation or recommendation. BenitaSana only provides the technical infrastructure and assumes no responsibility for selection, verification, or recommendation.
The decision to use an offer, which provider to select, and under which conditions a service is provided lies solely with the participating users. BenitaSana is neither involved in contract negotiations nor in the execution of the services and assumes no responsibility for the success, course, or outcome of the mediated services. BenitaSana provides no guarantee that a suitable offer is available for every support need, that offered services meet the individual expectations or requirements of users, or that offers are always or everywhere available.
BenitaSana operates exclusively a technical mediation, communication, and optionally payment platform.
BenitaSana does not provide its own services and does not act as a provider, contractual partner, representative, agent, or auxiliary.
Contracts are concluded exclusively and directly between provider and customer. BenitaSana is at no time a party to such contracts.
If the user does not have an account, they must first create one to use the BenitaSana App.
The user guarantees that the information provided during registration is complete, correct, and up to date. Users must immediately update any changes in the BenitaSana App.
Users explicitly agree to the activation and storage of location data. With consent for GPS-based location functionality from the mobile phone and the App, users can be regionally linked. Users may deactivate location services at any time, which significantly limits the functionality of the BenitaSana App.
Identity verification is mandatory for providers. An integrated program checks that the provider's personal data is correct. The verification provides security for customers and providers alike.
BenitaSana reserves the right to change these GTC at any time. The version valid at the time of platform use applies.
Ratings and reviews come exclusively from users. Service providers have the right to respond factually, truthfully, and fairly to reviews concerning them. Offensive, untrue, threatening, or promotional content is prohibited. Disclosure of personal data is particularly forbidden. Violations may lead to account suspension or deletion. BenitaSana reserves the right not to publish or delete reviews and statements without giving reasons. There is no entitlement to publication.
If payments are made through the platform, they are processed exclusively by external payment service providers. BenitaSana does not store payment data.
Assistenz im Alltag AG operates a customer service, which has an advisory function and assists with technical problems. Customer service randomly verifies whether services have been satisfactorily provided and has the right to record users' reviews. Users have the right to publish a response to the review.
Users are obliged to keep their access data to the BenitaSana platform, including username, password, and any authentication or security codes, confidential at all times and not disclose them to third parties. Users bear sole responsibility for all activities performed using their account, whether carried out by themselves or by unauthorized third parties. In case of suspected misuse, loss, or unauthorized access to account credentials, users must immediately inform BenitaSana and change their password. BenitaSana assumes no liability for damages or disadvantages resulting from misuse of an account.
There is no claim to uninterrupted, continuous, or error-free availability of the platform.
Platform operation may be temporarily restricted or interrupted, in whole or in part, for reasons including but not limited to:
To the extent permitted by law, BenitaSana excludes all liability. BenitaSana is not liable for damages or claims of any kind arising from or in connection with:
Liability of BenitaSana exists only in cases of intentional or grossly negligent conduct and only to the extent required by law.
Assistenz im Alltag AG reserves the right to transfer individual or all rights and obligations from these GTC to third parties or have them exercised by third parties.
Users may terminate their account at any time upon request. If there are outstanding invoices to providers/other users, the account will be suspended until payment is completed but not deleted. Assistenz im Alltag AG may exclude users at any time without giving reasons, i.e., terminate their account immediately, without users deriving any claims against Assistenz im Alltag AG. This applies in particular in the event of violations of these GTC or contracts with other users. Assistenz im Alltag AG may also temporarily block accounts without issuing a termination. Excluded or blocked users have no right to re-register without prior explicit consent from Assistenz im Alltag AG.
If individual provisions of these GTC are invalid or become invalid, the validity of the remaining provisions remains unaffected.
All disputes related to these GTC between Assistenz im Alltag AG and users are subject to Swiss law. The place of jurisdiction is Oberwil BL, Switzerland.
